I designed the Duo strap in July 2008. Photohgraphs of the Duo strap first appeared in public on The Baby wearer forum In September 2008. In 2009 after carrying out an extensive "Due Diligence" exercise to ensure that we were in fact entitled to claim the Duo strap as an original design, we submitted an application to the OHIM in Madrid.
The details of the Duo strap design can be found on the OHIM website, the Design Registration number is: 001622135-0001 (if you are having difficulties in finding the details you can search for "Duo Strap" or "Kerry Berry" ) where photographs and drawings of my design can be found. I have sought clarification on the description that was approved with this Design Registration as it is relevant when taking into consideration any similar designs that people may wish create. The Duo strap is described as having "an area of padding in the top section of the strap with a single layer of fabric thereafter".
I have been asked if I have the Copyright for the Duo straps, Copyright Does not apply in this instance. Copyright can only be applied to :
- literary works, including novels, instruction manuals, computer programs, song lyrics, newspaper articles and some types of database
- dramatic works, including dance or mime
- musical works
- artistic works, including paintings, engravings, photographs, sculptures, collages, architecture, technical drawings, diagrams, maps and logos
- layouts or typographical arrangements used to publish a work, for a book for instance
- recordings of a work, including sound and film
- broadcasts of a work
Also please note: a Patent can not be applied to a strap design, as the carrier on which my Duo straps are sewn is based on an traditional Asian design that is many years old. I have never claimed that the "Mei Tai" on which my wrap conversions are based was my invention.
I am always happy to speak to any carrier manufacturer who has evidence that they created a combined shoulder strap in or around June 2008 .
